Terms of Service

Effective Date: May 24, 2026. These terms govern your access, licensing, and usage of the Orensio AI autonomous sales representation platform.

1. Acceptance of Terms

By registering an account, purchasing a subscription plan, or accessing any service provided by Vishwakarma Group LLC ("Orensio", "we", "us", or "our"), you agree to be strictly bound by these Terms of Service (the "Terms").

If you are entering into these Terms on behalf of a company, organization, or another legal entity, you represent that you have the full legal authority to bind such entity. If you do not agree to these Terms, you must not access or utilize the Orensio platform.

2. License & Platform Access

Subject to your payment of all subscription fees and compliance with these Terms, Orensio grants you a non-exclusive, non-transferable, revocable license to access our web dashboard and configure our autonomous AI SDR to execute lead outreach on behalf of your brand.

You agree not to:

  • Use the autonomous sequence platform to dispatch spam, bulk unsolicited communications, or content that violates global anti-spam regulations (CAN-SPAM, CASL).
  • Reverse engineer, translate, or copy the proprietary AI Engine or database designs developed under Orensio systems.
  • Attempt to bypass or trick plan-based gates, subscription routing mechanisms, or monthly limitations.

3. Subscription, Payments & Stripe

Orensio operates as a recurring software-as-a-service model with fees paid in advance:

  • Billing Process: All transactions are securely processed via Stripe Inc. All payments are billed automatically on a recurring monthly or annual schedule depending on your selection.
  • No Loophole Bypass Policy: New accounts must register a valid payment instrument and complete a checkout session to activate their subscription before gaining access to the campaign dashboard.
  • Immediate Charge Policy: Subscriptions are charged immediately upon checkout. Private Beta guarantees restrict onboarding to preserve server resources and deliverability limits.
  • Refunds: Given the severe costs of specialized domain configurations, SPF/DKIM audits, and background GPU resources dedicated instantly to sandbox setups, Orensio maintains a strict no-refund policy for premium plans unless agreed by Eliana or a dedicated CSM.

4. Sequence & Lead Limitations

Our plans feature strictly enforced software limits to protect deliverability and maintain fair resource usage:

  • Starter Plan: Restricts sequence steps to a maximum of 4 per campaign. Does not include HubSpot sync, custom API access, or automated LinkedIn gateways.
  • Growth Plan: Restricts sequence steps to a maximum of 7. Includes automated LinkedIn sandboxed integrations.
  • Scale & Agency Plans: Up to 10 sequence steps, full HubSpot syncing, multiple CRM actions, dedicated Slack support, and multiple client workspaces.

Attempting to alter sequence arrays or lead queries using direct API overrides will result in immediate campaign rejection by backend validators.

5. Autonomous SDR Disclaimer

Orensio utilizes AI models to dynamically generate outreach messages and follow-up sequences. While Orensio’s models are highly sophisticated and configured for professional and direct business tones:

  • You maintain final administrative responsibility for the domains, SPF/DKIM DNS mappings, and custom Calendly slots connected to your campaign.
  • Orensio is not liable for any misinterpretations, brand disputes, or domain reputation degradation resulting from the autonomous activities of the AI SDR.
  • Outreach sequences to professional profiles are dispatched through isolated, sandboxed gateway session tunnels to ensure high deliverability and compliance.

6. Intellectual Property

The Orensio name, brand colors, logo, frontend components, and the proprietary Orensio AI Engine (including all algorithms, background routines, and automated sequences) are the exclusive property of Vishwakarma Group LLC and are protected by international trademark and patent law.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, AND EXCEPT AS OTHERWISE REQUIRED UNDER THE UK CONSUMER RIGHTS ACT 2015 OR THE AUSTRALIAN CONSUMER LAW: IN NO EVENT SHALL VISHWAKARMA GROUP LLC BE LIABLE FOR ANY INDIRECT, SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR INABILITY TO USE THE PLATFORM.

OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY YOU TO ORENSIO DURING THE TWELVE (12) MONTH PERIOD PRECEDING THE EVENT GIVING RISE TO LIABILITY.

8. Account Termination

You are free to cancel your active subscription plan at any time through our Stripe Customer Portal link inside the dashboard. Cancelled plans remain active until the end of the current billing cycle, at which point all automated campaigns are paused.

We reserve the right to suspend or terminate accounts instantly if we detect malicious API attacks, sequence spamming, or credit card fraud.

9. Dispute Resolution & Regional Laws

Because Orensio AI operates internationally across the United States, United Kingdom, and Australia, specific local consumer protections apply:

A. United States (Delaware Law & Arbitration)

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles. Any dispute arising out of or relating to these Terms shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. You and Orensio agree to waive any right to resolve disputes in court or to participate in any class action lawsuit.

B. United Kingdom Consumer Safeguards

If you are a consumer residing in the United Kingdom, nothing in these Terms (including Section 7) shall exclude or limit Orensio's liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any other liability which cannot be lawfully excluded or limited under the UK Consumer Rights Act 2015.

C. Australian Consumer Law (ACL) Guarantees

If you are a consumer under the Australian Consumer Law (Competition and Consumer Act 2010), our services come with statutory consumer guarantees that cannot be excluded, restricted, or modified. To the extent permitted by law, Orensio's liability for a breach of a non-excludable consumer guarantee is limited to the resupply of the services or the payment of the cost of having the services supplied again.

Mandatory Disclosure Statement: "Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled to cancel your service contract with us, and to a refund for the unused portion, or to compensation for its reduced value."
